Please Read this "AGREEMENT"  before anything else, is the actual document you will have to sign during the check-in (pick-up) process

1. VEHICLE USE

Renters are allowed to use the rented vehicle for personal use, for business or for hire, car sharing (Uber, Lift, door dash etc. Will use and operate the Rented Vehicle only on properly maintained roads and parking lots. Renter will comply with all applicable laws relating to holding licensure to operate the vehicle and pertaining to operation of motor vehicles. Renter WILL NOT use vehicle for illegal activities or will forfeit the deposit and could pay us a fine up to $5,000.00.

2. MILEAGE

The mileage of the Rental Vehicle starts at the time of commencement of this Car Rental Agreement and will be limited to 100 miles per day. Any mileage on the vehicle over this limitation without a written preauthorization and payment will be subject to an excess mileage surcharge of $.39 per mile.

3. SECURITY DEPOSIT

Renter will be required to leave a security deposit to Owner, in (cash, zelle, other) refundable in 3 days after vehicle return. This is to be used in the event of minimal damage to the Rental Vehicle or to cover unpaid charges like toll roads, parking violations, strong odors, excess dirt etc., during the term of this agreement. If the cost for repair or replacement of damage to the Rental Vehicle exceeds the amount of the Security Deposit, Renter will be responsible for the difference on this cost. Renter will forfeit the deposit if the vehicle is returned with a fragrance to cover odors or there is evidence of smoking tobacco or other substances.

4. INDEMNIFICATION

Renter agrees to indemnify, defend, and hold harmless the Owner for any loss, damage, or legal actions against Owner because of Renter’s operation or use of the Rented Vehicle during the term of this Car Rental Agreement. This includes claims to the owner’s liability insurance, any attorney fees necessarily incurred for these purposes. Renter will also pay for any parking tickets, moving violations, or other citations received while in possession of the Rented Vehicle.

5. RATES & OTHER CHARGES

The use, rates, and pricing of the rental vehicle are valid only during the term of this agreement. The vehicle must be returned by the due day and time promised, otherwise the renter will forfeit the deposit and the vehicle will be shut down to protect our interests. Any desire to extend rental time from the original agreement must be requested and approved before the due date in writing (text, paper, email, messenger) ORAL PROMISSE ARE NOT VALID! (E.g., you, he, she, they told me. I understood this or that, I supposed... etc). We reserve the right to approve/deny the next rental period and to increase/keep the rate. All payments for the next rental period must be paid before the end of the current rental agreement.

Renter will pay us all parking and traffic fines, toll violations, penalties, citations, court costs, towing, storage, impound charges and other expenses involving the Vehicle assessed against us or the vehicle, an administrative fee of $20.00 will be added for each such violation. 

Towing & Impound will result in the forfeiture of the deposit to cover storage and extra fees to recover the vehicle. All costs, including pre- and post-judgment attorneys’ fees, we incur collecting payment from you or otherwise enforcing our rights under this Agreement.

6.  CLEANING FEE & GASOLINE RULES

Renter agrees and understands the rented vehicle is a NON-SMOKING (Tabaco/Marihuana etc.) vehicle and agrees to pay no more than $450.00 if not comply. Vehicle must be returned with NO fragrances (to cover odors) or renter will forfeit the deposit.

Renter can bring the vehicle with any fuel level with no penalties or extra fees. The only exception to this rule is if car is returned with the low fuel warning light ON. A $25.00 will be deducted from the deposit or charge to the credit card on file.

7. REPRESENTATIONS AND WARRANTIES

The owner represents and warrants the Rental Vehicle is in good condition and is safe for ordinary operation of the vehicle. Renter is legally entitled to operate a motor vehicle under the laws of this jurisdiction and will not operate it in violation of any laws, or in any negligent or illegal manner.

​Renter has been given an opportunity to examine the Rental Vehicle in advance of taking possession of it, and upon such inspection, is not aware of any damage existing on the vehicle other than that notated by separate Existing Damage document.

8. JURISDICTION AND VENUE

In the event of any dispute over this agreement, this Car Rental Agreement will be interpreted by the laws of Texas, and any lawsuit or arbitration must be brought in the corresponding region of [Texas]. If any portion of this agreement is found to be unenforceable by a court of competent jurisdiction, the remainder of the agreement would still have full force and effect.

9. BREAKDOWNS

To avoid being charged for any breakdowns, Renter must inform the owner immediately of any dashboard lights on, weird sounds or any other “not feeling right” situation and must follow owner’s advice.

Failures, breakdowns, or accidents must be reported immediately by calling or texting to our main number at 713-774-7426.or after hours.

(832-573-6996). If we authorize the renter to repair or solve the problem, we will reimburse any expenses paid by the renter with the proper receipts. DON’T USE cheap non-brand gasoline or you will be responsible for any damages to the car.

NOTE: In case we cannot replace with a new rental vehicle, we will provide FREE, a taxi, Uber, Lift service (up to 20 miles from the breakdown) if the authorized driver is within the time frame of this agreement. 

10. GPS & STARTER INTERRUPT

The Vehicle has been equipped with a GPS device designed to protect our interests in the scope of the rental vehicle. Any intention of tampering, disconnecting or removal will be considered as an intent to deprive the owner and will be reported to the proper authorities. Car will be shut down if driving outside of the 100-mileage range limit from Downtown Houston.

11. MAINTENANCE, CARE & REGULAR COMMUNICATION

To have our cars in top condition, we take maintenance very seriously, so from time to time, we may come in person to the car’s location for maintenance and to check vehicles condition. (Renter will be informed by call, text or messenger). Alternatively, we can request pictures or video of the interior/exterior, stickers, insurance, oil and coolant levels, tires, tire pressure, air filters etc. Renters have the option to come to our location so we can perform these services at no cost for the renter. Note: Vehicles with odors (smoked-in, weed, animal, fluids, etc.) will be turned off immediately. Deposit and ALL payments made will be forfeited!! renter must be available to always respond to our calls or texts within a reasonable frame time, otherwise vehicle will be shut down and a theft report will be filed to the proper authorities.

12. INSURANCE

a: _________ I will use my insurance to cover damage or lost to the Rental Vehicle. I will use my insurance to cover injuries I cause to someone else while driving, damage I cause to someone else's property, legal expenses for accidents-related lawsuits if the police name me as the at-fault driver in a crash. I will be TOTALLY responsible for the events before mentioned if my insurance denies a claim.

b: _________ I agree to use the vehicle owners’ collision and comprehensive insurance If the Rental Vehicle is damaged or destroyed while it is in my possession, I agree to pay the insurance deductible of $1,500 and assign all rights to collect insurance proceeds to Owner. I understand owner's liability insurance does not cover accidents or claims to ANY person or property while driving this rental car. I agree to obtain my own liability insurance in case the police name me as the at-fault driver in a crash or accident and a Personal Injury Protection Insurance to cover me in the event of an accident. I was offered the opportunity to purchase liability Insurance, but I rejected it.

13. ENTIRE AGREEMENT

This Car Rental Agreement constitutes the entire agreement between the Parties with respect to this rental arrangement. No modification to this agreement can be made unless in writing signed by both Parties. Any notice required to be given to the other party will be made to the contact information below.

ALL RENTAL CHARGES ARE ON A "PREPAID BASIS" MEANING THE CAR WILL SHUT DOWN WHEN THE PREPAID TIME EXPIRES so please make payments BEFORE the expiration date

I UNDERSTAND AND AGREE WITH THE ABOVE RULES AND REGULATIONS 

(Non-named drivers will void this agreement. The car will be shut down; any payments and deposits will be forfeited.
